BY USING OUR WEBSITE, APP, AND/OR SERVICES YOU ACCEPT THESE TERMS AND AGREE TO VOLUNTARILY WAIVE ANY RIGHT TO TRIAL BY JURY OR A CLASS ACTION LAWSUIT AGAINST TERIYAKI MADNESS FOR ANY DISPUTE IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS OF USE, OUR PRIVACY POLICY, DATA SECURITY, OR DATA PRIVACY.

Contests, Drawings & Giveaways

Teriyaki Madness contests, drawings, and giveaways or other similar promotions (collectively, “Promotions”) are governed by their individual rules, as well as our Privacy Policy which is incorporated herein. By participating in Promotions, you acknowledge and agree that any information you submit, or we collect, may be used in accordance with you Privacy Policy.

Free Bowls for a Year and/or Free Bowls for a Month Giveaways

Rules apply to Teriyaki Madness locations promoting this giveaway, typically for, but not exclusive to, Grand Opening or Anniversary events, or email promotions distributed intermittently by Teriyaki Madness corporate offices. Prizes will be awarded based on app account orders placed during the specified timeframe per market and per promoted campaign. 25 people who purchase in the app will be randomly selected to win. 5 people will receive 24 electronically awarded vouchers for a free Jr. or Reg.-Sized bowl as “FREE TMAD FOR A YEAR,” awarded every 2 weeks for 12 months; and 20 will receive 4 electronically awarded vouchers for a free Jr. or Reg.-Sized bowl as “FREE TMAD FOR A MONTH,” awarded weekly for 4 weeks.

Only one voucher can be used per transaction, online, in-app or in-shop. Vouchers are not valid with other offers or discounts, and taxes may or may not be included depending on your state. You must be 18 to be eligible. Teriyaki Madness employees are not eligible to participate in the giveaway. Limit one giveaway awarded per household.

For other promotions by market using “Free TMAD for a year” Or “Free TMAD for a month” in their local promotions, the quantities for each listed above also apply to those prize offerings.

Winners will be emailed and/or sent a push notification through the TMAD app regarding their winnings and their voucher. Vouchers must be redeemed before the expiration date noted on each voucher otherwise the vouchers are forfeited. See Winner Notification below for details on the electronic communication expected. Teriyaki Madness is not responsible to go above and beyond the winner notifications measures outlined below to contact the winners of this giveaway.

Entries must be received by the time specified in each promotion. Deadlines vary by promotion and market. Winners will be randomly chosen and emailed or sent push notifications through the Teriyaki Madness App to be alerted that they’ve won.

ADDITIONAL DETAILS: Multiple attempts to enter may disqualify the participant from being gifted any free bowl vouchers. Entrants MUST have an active MAD REWARDS account to receive their giveaway. Teriyaki Madness reserves the right to disqualify an entrant based on their interpretation of misuse or misrepresentation of Teriyaki Madness based solely on their determinations. Teriyaki Madness will have rights to reuse photography posts and reviews, posted by the winner as a result of this giveaway.

WINNER NOTIFICATION: Winners will receive an email from [email protected] and/or [email protected] and/or push notification through the TMAD app when the voucher is added to their MAD REWARDS account. Teriyaki Madness is not responsible for vouchers that may end up in spam folders or inadvertently missed through the normal use of the winners’ email inbox review. Winner must redeem vouchers electronically before the expiration date noted on each, otherwise the vouchers are forfeited.

All customers who download the Teriyaki Madness app and create an account using their email or their Facebook account, will be entered into a random drawing to win 4 Free Bowl vouchers or 4 free bowls loaded into the customer’s app account (Jr or Regular size bowls). You must be 18 to be eligible. Employees of Teriyaki Madness are not eligible. To redeem your voucher, submit the voucher at the time of payment to receive your free bowl. Vouchers are only valid in-restaurant. In-app free bowls are valid through the app, online or in the shop. No cash value, no photocopies, not valid with other offers or discounts and taxes may or may not be included depending on your state.

Battle of the Bowls

The winner will be randomly chosen from all comments posted on the photos in the promotion. Winner will receive “FREE TMAD FOR A MONTH”, which equates to 4 free bowl vouchers. You must be at least 13 years of age to comment. Teriyaki Madness employees are not eligible to participate in the giveaway.

General Terms

We reserve the right to change our Terms, and those terms that govern our gift cards, app, and website, from time to time in our discretion. These Terms are applicable to the extent permitted by law. If any of these Terms are deemed invalid, void, or for any reason unenforceable, then any unenforceable term will be deemed severed and will not affect the validity and enforceability of any remaining terms and conditions.

Gift Card Terms

Cards can be loaded with a minimum of $10 and maximum of $2,000. Redeemable up to the balance for food, product, beverage or alcohol (where permitted by law), including taxes or delivery charges at participating Teriyaki Madness restaurants. Not redeemable for cash except as required by law. Not a credit or debit card. Cards may not be valid at non-traditional locations such as casinos, airports or college campuses. Prepaid Card balance never expires, nor are any fees charged in connection with its use. Safeguard your Card. It will not be replaced or replenished if lost, stolen or used without authorization. Reloadable. Unauthorized resale is prohibited. If you purchase a gift card from a re-seller, you do so at your own risk, as cards sold by a re-seller may not have any value. Teriyaki Madness /M. H. Enterprises, Inc. “TMAD” is the Card issuer and sole obligor to Card owner. TMAD may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not TMAD, will be sole obligor to Card owner. Purchase, use or acceptance of Card constitutes acceptance of these Terms. Points will be earned when card is redeemed, but not when card is purchased.

Teriyaki Madness App Terms

The Teriyaki Madness App (the “App”) is offered by Teriyaki Madness and/or its franchisees. The App terms apply only to our App and the Rewards Program (defined below) offered herein, and not to any other website, mobile app, product, service, or program offered by us. The App terms are a legal and binding agreement between you and Teriyaki Madness governing your use of the App.

We may at any time, for any reason, and without notice or liability: (1) modify, suspend, or terminate operation of or access to the App or any portion thereof; (2) change, revise, or modify the App or any portion thereof; (3) interrupt the operation of the App or any portion thereof for maintenance and support; (4) impose limits on certain features and services, or restrict access to the App; and/or (5) terminate the authorization, rights, and license given above. Upon any termination, the rights and licenses granted to you herein shall terminate, and you must cease all use of the App.

You agree to use the Teriyaki Madness App in accordance with these App terms and all applicable laws and regulations. We may prohibit access, use, conduct, communications, or content that we, in our sole discretion, deem to be harmful to this App, the content, users, us, our brand, or any other person or entity, or that violates these App terms & Conditions and/or applicable law.

Rewards Program

The Teriyaki Madness App Rewards Program (the “Rewards Program”) rewards and thanks our loyal restaurant customers. The Rewards Program is available to enrolled members at participating Teriyaki Madness restaurants in the United States. Rewards accumulated under the Rewards Program are promotional and have no cash value. There are no membership fees associated with the Rewards Program.

You may enroll in the Rewards Program if you: (1) are a legal resident of the United States; (2) at least 18 years of age at the time you enroll; (3) have an active, valid email address; and (4) are a human being. No corporations, partnerships, limited liability companies, or other legal entities can participate in the Rewards Program.

The Rewards Program is not targeted towards, nor intended for use by, anyone under the age of 18. If you are under 18, you may only the Rewards Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

You may enroll in the Rewards Program and create a Rewards Account by:

• Enrolling through your Facebook account using the App[KB2.1][AB2.2]; or
• Signing up directly through the App using your email or Apple ID.

Your Rewards Account is personal to you and may not be sold, transferred or assigned to, or shared with family, friends or others. You may have only one (1) Rewards Account.

As a part of the Rewards Program, we will send you transactional, informational, and promotional messages and/or offers. These communications may happen in the form of push notifications through the App, email, and/or any other ways you may have selected when you enrolled in the Rewards Program. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages, please log into your Rewards Account and update your contact information or preferences. If you are unable to make edits to your contact information or preferences, please email [email protected] with the subject line “Contact information update request.”

Referral Bonuses: You may receive an extra product discount for every friend you refer who joins our Rewards Program and starts using the App. Your extra discount will not be awarded until the referred member enrolls in the Rewards Program, references your invite code at sign-up and makes their first purchase.

Each Reward is valid for the dates specified on the offer within the App rewards section.[KB3.1][AB3.2]

Additional Rewards Program Terms

We reserve the right to terminate your Rewards Account and/or your participation in the Rewards Program in our sole discretion. We may also, in our sole discretion, suspend, cancel, or combine Rewards Accounts that appear to be duplicative, and may refuse to allow you to re-enroll in the Rewards Program. We also reserve the right to “unregister” and make ineligible for the Rewards Program any Rewards Account that has been inactive for one year. Inactive is defined as no Rewards earned. Accrued points will expire if more than 365 days occur between purchases.

We have the right at any time, with or without giving you prior notice, to:
• end or cancel the Rewards Program and/or any specific Reward;
• change any Reward or other Rewards Program benefit we offer;
• change the requirements for earning a particular Reward;
• change the time you have in which to earn a particular Reward; and/or
• change any other feature of the Rewards Program.
• If we end the Rewards Program, Rewards you have earned but not used will expire on the end date, and you may not redeem any Rewards or use any credits after the end date.

Login and Registration

Certain features or services offered on or through our App may require you to complete a registration process and/or set up an account or login. You agree to (1) provide true, accurate, current, and complete information about yourself, and (2) maintain and promptly update your information to keep it true, accurate, current, and complete. You are responsible for maintaining the confidentiality of the information you hold for your login, including your password. You agree to notify us immediately of any unauthorized use of your login, or any other breach of security. You may be held liable for losses incurred by us or any other App user or visitor due to someone else using your login as a result of your failing to keep your login information secure and confidential.

You may not use anyone else’s account or login information. Teriyaki Madness shall not be liable for any loss or damage arising from your failure to comply with these obligations.

International Users

Our App is controlled, operated, and administered from offices within the United States. We make no representation regarding use of this App outside of the United States. You may not use this App or export any portion of it in violation of U.S. export laws and regulations. If you access this App from locations outside of the United States, you are responsible for compliance with all local laws.

Governing Law/Venue

The Teriyaki Madness website, App, and services are governed by and subject to the laws of the State of Colorado, USA, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in Colorado for any disputes arising out of these Terms, the App, or the Rewards Program. Notwithstanding this provision, you agree that Teriyaki Madness may apply for injunctive or other equitable relief in any court of competent jurisdiction.

No Warranties

THE TERIYAKI MADNESS APP, THE CONTENT, AND THE REWARDS PROGRAMS ARE PROVIDED ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND TERIYAKI MADNESS HEREBY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, TERIYAKI MADNESS DOES NOT GUARANTEE THAT THE APP OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitations of Liability

IN NO EVENT SHALL TERIYAKI MADNESS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY DAMAGES (DIRECT OR INDIRECT) WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THIS APP (INCLUDING ITS MODIFICATION OR TERMINATION), THE CONTENT, THE REWARDS PROGRAM, OR THESE TERMS OF USE, WHETHER OR NOT TERIYAKI MADNESS MAY HAVE BEEN ADVISED THAT ANY SUCH DAMAGES MIGHT OR COULD OCCUR AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.

Electronic Communications

By communicating with us electronically via the website, App, or our services, you consent to receive electronic communications from us. You agree that all notices, disclosures, agreements, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms & Conditions.

General Provisions

All or any of Company’s rights and obligations hereunder may be assigned to a subsequent owner or operator of this App in a merger, acquisition or sale of all or substantially all of Company’s assets. If, for any reason, a court of competent jurisdiction finally determines any provision of these Terms and Conditions or any portion thereof to be unenforceable, such provision will be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms and Conditions will continue in full force and effect. Company’s failure to act with respect to a breach by you or others does not waive Company’s right to act with respect to that breach or subsequent or similar breaches.

You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS, MMS, and RCS) messages from Teriyaki Madness, including text messages that may be sent using an automatic telephone dialing system and/or AI-assisted technology, to the mobile telephone number you provided when signing up or any other number that you designate. You agree that you consent to receive such messages regardless of any state or federal time of day restrictions and/or the presence of your telephone number on any state or federal Do Not Call list/registry. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply.

Message frequency will vary. Teriyaki Madness reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Teriyaki Madness also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Not all mobile devices, handsets, or carriers may be supported and our messages may not be deliverable in all areas. Messages may not be deliverable if you add digits or symbols to our phone number. Teriyaki Madness, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

Cancellation
